The appeal is dismissed because the Tribunal gave GMCL a reasonable opportunity to be heard; the proposed witnesses would not have materially assisted on the central factual issue (interpretation of the plan), and refusal to transfer or further adjourn did not cause prejudicial unfairness to GMCL.

Debarring order made by the Family Court pursuant to an unopposed unless direction was valid and unappealed and cannot be collaterally attacked on this appeal; the High Court was entitled to rely on the s38 report despite its stated limitations and to make interim orders including declaration that the 999 Seapro shares were respondent's separate property and an interim payment order; failure to give further formal notice to trustees did not invalidate the orders on the evidence before the Court.

The application for leave to appeal was refused because the District Court correctly found that the Work Capacity Assessment Procedure was followed, the appellant had adequate notice and opportunity to be heard, the decision on capacity for work was a factual assessment rather than an error of law, and no question of law arose under section 97 that would justify leave to the High Court.
