R v PETERSEN & HEMA [2022] NZHC 2742

The Judge erred in principle by giving credit for pre-sentence remand (prohibited by s 82 Sentencing Act), by allowing an excessive combined discount for remorse, rehabilitation and cultural factors without robust causal nexus, and by crediting time on EM bail despite offending while on bail; because those errors produced a non-custodial home detention outcome that was not available, the Crown appeal was allowed and the home detention sentence was set aside and replaced with an appropriately quantified custodial sentence.

HOUKAMAU v POLICE [2022] NZHC 152

The Court held the 12 month starting point was within range given the premeditated and relatively sophisticated targeting of a vulnerable elderly victim and the single transfer of $2,100; an uplift for extensive prior dishonesty convictions and offending while on sentence was appropriate though at the high end; the cultural report and mental health issues warranted a larger discount than 10 per cent but not as high as 25 per cent, resulting in substitution of the 11 month sentence with nine and a half months' imprisonment.

Late guilty pleas entered after the complainant had given evidence and cross‑examination commenced did not justify any guilty plea discount; however, the judge erred in underweighting the mitigating effect of the offender's severe disadvantaged childhood and cultural deprivation and an additional 12‑month discount was warranted, resulting in substitution of the sentence to 7 years 6 months while confirming the minimum period of imprisonment of 4 years 3 months.

Preventive detention was declined by a narrow margin because, although the offender posed a high assessed risk and had prior similar offending, the combination of his guilty plea and remorse, prior treatment participation, the realistic prospect of further culturally focused treatment and literacy work, the protective possibility of an Extended Supervision Order on release, and the mitigating effect of age and health made an eight years six months determinate sentence with a minimum period of five years six months adequate to protect the community.
