The Court held there was no material defect apparent on the face of Dr Finucane's psychiatric opinion, no competing qualified medical evidence to raise a serious question of reliability, and ACC acted reasonably in relying on that opinion and in revoking the deemed decision and declining cover; accordingly the appellant failed to prove on the balance of probabilities that his mental injury was directly caused by the physical injuries.
