Section 432 of the Immigration Act 2009 preserved the applicability of the 1987 Act to persons subject to deportation orders made under the 1987 Act; therefore the applicant remained governed by the 1987 Act and could not bring a refugee or protected person claim under the 2009 Act, rendering the RSB decision void and the IPT without jurisdiction to hear the appeal.

Leave to appeal was refused because the Tribunal properly considered the mandatory s105(2) factors on the evidence, the applicant's complaints were essentially factual or involved non‑material errors (the jury/bench misstatement and minor sentencing note inconsistency), the identified factual errors did not amount in combination to an error of law nor raise questions of general or public importance, and therefore no lawful basis for granting leave under s245(3) was established.

There was a seriously arguable ground of appeal that the Tribunal may have failed to give adequate weight to the applicant's youth (and related matters); deportation would materially and irrevocably worsen the applicant's position and could render any successful appeal nugatory; balancing the prospects of success against the consequences favored granting a discretionary stay pending the appeal, conditional on the applicant pursuing the appeal promptly.

The Court held the Tribunal's findings that the qualifying offending was serious and that it would not be contrary to the public interest for the appellant to remain were both open on the evidence and not insupportable; the Tribunal appropriately weighed the s105(2) factors and did not err in law, therefore the appeal is dismissed.

Dismissal because the applicant has no realistic prospect of success: his statutory humanitarian appeal rights were exhausted by 1 May 2010, transitional provisions bar a fresh appeal, deficiencies of his immigration consultant do not excuse the failure to appeal, and therefore s8 interim relief was not justified and the deportation order of 16 December 2010 was lawful.
