Bailey v Accident Compensation Corporation (Suspension of Entitlements)
- Citation
- [2019] NZACC 34
- Court
- District Court
ACC had a sufficient evidential basis to be not satisfied that the claimant was entitled to continue to receive entitlements when it suspended them; the claimant's cover was for groin contusion and back sprain and the hip pathology was pre-existing osteoarthritis rendered symptomatic or aggravated by the accident but not shown to be an injury caused by the accident; treating surgeon did not identify a new physical injury causally causing the ongoing symptoms, so ACC's suspension and decline of weekly compensation were justified and the appeal was dismissed.
