While a non‑binding promise ('gave his word') was made by Zane to look after Angus, the promise lacked the requisite certainty and intention to create legally enforceable contractual obligations; further, if a binding agreement had existed it would have been unenforceable as contrary to public policy because it tended to frustrate the Proceeds of Crime Act; part performance did not cure the deficiency; accordingly the plaintiff's claim failed.
