Given that Aston Investments Ltd's proprietary security includes the redevelopment covenant and its rights will be directly affected, the court granted a limited form of intervention: Aston is permitted to address the court in final submissions on the construction of the covenant as if a defendant under r10.10, but is not permitted to lead evidence or cross-examine witnesses; this limited participation protects Aston's interests while minimizing prejudice to the existing trial timetable.
