The application for leave to appeal is dismissed because the Court of Appeal lawfully applied the B (SC12/13) v R principles, offered a rational, evidence-based explanation for the single conviction amid other acquittals (noting the stand-alone nature of the shower incident and supporting factors), and there is no appearance of a miscarriage of justice warranting Supreme Court intervention.

The conviction is upheld because the jury could rationally distinguish the shower incident from the other allegations based on its different circumstances and contemporaneous evidence (complainant's report to a nurse, nursing observations of controlling behaviour and the effect of the complainant's surgical wounds), so the verdicts are not logically irreconcilable and appellate intervention was not justified.

Extension of time was granted; on review the jury verdicts were not unreasonable because the quality and context of evidence differed between incidents allowing rational verdicts; inconsistencies alleged were reconciled by differences in specificity and context; sentencing was within the available discretion and not manifestly excessive despite technical double counting of indecent assaults; modest credit for good character was appropriate; publication order under s200 was made to protect complainants.

The jury could reasonably, on the totality of scientific and circumstantial evidence, be satisfied beyond reasonable doubt that Milner administered promethazine without Mr Nisbet's knowledge; the Crown was not required to prove as a separate essential fact the precise mechanical means of administration and the appeal is dismissed.

Leave to appeal dismissed because the jury was entitled to rely in part on inferences of continuity from similar shipments and, on the totality of the evidence, conviction was open; there was no arguable error in the treatment of party liability, no question of general or public importance, no appearance of miscarriage of justice, and no sufficient basis for a second appeal against the life sentence.
