Given the exceptional procedural circumstances (co-accused Z had been granted leave and the issue under s 195 was common to both), the Court exercised its discretion to extend time and grant leave to appeal directly to the Supreme Court so that the conviction under s 195 could be determined in relation to both appellants together, and set a timetable and hearing date.

The application for leave to appeal was dismissed because the Court of Appeal had correctly found no error warranting further appeal, the refusal of leave by the Court of Appeal is final under s 213(3) Criminal Procedure Act 2011, and no exceptional circumstances existed to justify a direct leap‑frog appeal from the High Court.

The recall application was dismissed because the original judgment correctly declined jurisdiction to grant leave to appeal the Court of Appeal's refusal to extend time and, regarding the leap‑frog application, there were no exceptional circumstances, no matter of general or public importance, no risk of substantial miscarriage of justice and the merits were weak; the Court's brief general reasons satisfied s 16(2).

The recall application is dismissed because the High Court had in fact considered and ruled on the s 358(1) argument, the application lacked substance, and there were procedural and jurisdictional defects in the challenges; consequently no exceptional grounds for recall existed.

Leave to appeal was dismissed because the applicant failed to demonstrate compelling or exceptional circumstances to circumvent the s7 jurisdictional limitation or to warrant a leap‑frog appeal, and because the High Court and Court of Appeal correctly found most claims to be collateral attacks, abuses of process or not reasonably arguable, although the applicant may proceed to trial on complaints about his arrest and failure to be notified of the second information.
