On the balance of probabilities the applicants demonstrated that the first respondent had left the country, that the respondents had a case to answer for fraudulent misapplication of funds, and that service had been effected by email; accordingly the without‑notice application was revived and granted and service was treated as effected.

The judge refused the adjournment because the Registrar's allegations were verified by affidavit, there were no good reasons to adjourn, and the public interest in preventing further investor harm required the application to proceed immediately; accordingly the plaintiff was entitled to proceed at the first calling.
