Court declined to resolve disputed factual issues on the limited untested evidence, treated the withdrawal of the statutory demand as akin to discontinuance, and awarded 2B scale costs and disbursements to applicant Triple Eight Contractors Ltd totalling NZD 14,794.30; no uplift or indemnity costs were awarded and substituted service did not attract more than scale costs.

The application to rescind the 16 October 2017 interlocutory dismissal under r 7.49 is dismissed because none of the narrow grounds for rescission are met (no full argument or overlooked evidence, no material change of substance, no special circumstances), the Court of Appeal's settled authority that ordinary consequences of deportation do not ordinarily justify interim relief is binding, and the without‑notice process and failure to serve the respondent constituted misuse of process sufficient to deny relief.

Because no adverse finding was made against Z, the statutory framework presumes confidentiality of Standards Committee complaints, publication would cause real and material harm to Z, and the applicant misused the Court's process by failing to pursue statutory remedies, the interests of justice favour permanent name suppression for Z while the applicant's interim suppression is lifted.

The Court held it was just to order non-party costs against Mr Clode, Ms Cooper and Wanganella Trustee Ltd because they deliberately used the injunction and then transferred Fern's sole asset to WTL and put Fern into liquidation to defeat FTL's ability to recover costs and extinguish its security; LJK and Mr Gilbertson were not ordered to pay because they did not control the litigation and no sufficient basis for liability was proved; strict causation was not required given the deliberate conduct to frustrate costs recovery.
