Although the Judge should not have accepted and treated as aggravating the inference that the appellant brought the weapons to the address without offering a disputed facts hearing, the overall starting point, uplifts and the end sentence of two years and three months' imprisonment were within the available range and the appeal is dismissed.

Because the offending involved a dangerous, sawn-off firearm that was discharged in an urban area, prolonged detention, repeated violence and threats, theft, and significant victim impact, the court set a global starting point of seven years imprisonment (including a six-month uplift for retention of the unsafe firearm); after discounts of six months for youth and six months (approx 9%) for guilty pleas that saved trial costs but were later sought to be vacated, the effective sentence is six years imprisonment to be served concurrently across counts.
