The reviewer’s decision was upheld because on the balance of probabilities the medical evidence (preferred Dr Kenny over Dr Dryson) did not establish a discrete objective physical injury caused by a work-related property or characteristic and the evidence indicated significant contribution from non-physical work stress, which is excluded by s33(3)(c); therefore the appellant failed to prove entitlement under s33 and the appeal is dismissed.
