HUNTLEY v R [2023] NZHC 3236

RYLAND v NEW ZEALAND POLICE [2023] NZHC 2100

The District Court failed to demonstrate it had applied the statutory thresholds for imposing a supervision sentence under s46 and for imposing the special rehabilitative condition under ss50 and 52 (significant risk of further offending and inadequacy of standard conditions); the supervision sentence was not shown to be the least restrictive appropriate outcome and therefore must be quashed and substituted with an order to come up for sentence if called upon within six months.

Permanent name suppression was necessary because publication would be likely to cause extreme hardship to the defendant given his FASD, intellectual disability, high suggestibility and history of social alienation; that hardship would jeopardise rehabilitation and increase the real risk of reoffending and public harm, and the discretion to suppress should be exercised because open justice is satisfied by permitting publication of diagnoses and reasons for sentence.

R v NELSON-BELL [2023] NZHC 799

The court was satisfied the defendant failed to comply with home detention conditions, that continuation of home detention was not necessary to meet sentencing purposes for community safety and accountability, and accordingly cancelled home detention and substituted a term of imprisonment as permitted by s 80F, adjusting the substituted term to account for the unserved portion of the home detention sentence pursuant to s 80G(2).

O’ROURKE v NEW ZEALAND POLICE [2023] NZHC 693

The High Court found the electronic monitoring conditions lacked sufficient nexus to the statutory purposes in s93(3): GPS monitoring did not materially promote rehabilitation, had limited utility to reduce general risk to unspecified members of the public, and was not necessary to protect the victims given other conditions. The GPS conditions were therefore deleted as disproportionate and replaced with targeted, less intrusive conditions (medical attendance and notification of relationships).

FOLSTER v NEW ZEALAND POLICE [2023] NZHC 292

SINGH v NEW ZEALAND POLICE [2022] NZHC 3002

Use of RoC*RoI within the IOMS as an actuarial input to generate a preliminary security classification is lawful and consistent with the Corrections Act and Regulations; the statutory scheme and Corrections' guidelines anticipate actuarial tools but require individualized assessment and permit overrides; Corrections applied the process lawfully in the applicant's case, the override mechanism prevents fettering of discretion, and the applicant did not establish arbitrary detention, rights breaches under NZBORA or international instruments, or misfeasance by officials.

Publication of the appellant's name would likely cause hardship by hindering rehabilitation and risking relapse, but the evidence did not meet the very high statutory threshold of 'extreme hardship' under s200(2); accordingly, on balance the principle of open justice prevails and permanent name suppression is refused.
