Because the applicant remained validly remanded in custody under a warrant requiring his appearance before the District Court on 10 October 2023, the habeas corpus application was an abuse of process and was dismissed under s 15(1) of the Habeas Corpus Act 2001.

Leave to appeal was granted because the application raised two properly identifiable and arguable questions of law: (1) whether the presiding Judge had jurisdiction to enter not guilty pleas after ordering s 38 health assessments, and (2) whether it is lawful or in the defendant's interests under s 8(1) CP(MIP) Act to postpone a fitness determination and remand solely because no hospital bed is available; the High Court directed that these questions proceed to hearing with timetable directions.

Questions about the length of remand in custody while CP(MIP) Act assessments are prepared are custodial status matters lacking the requisite close connection to the determination of the charge and therefore outside the jurisdiction of s 296; only questions integral to the determination (for example entry of a plea or whether to postpone a fitness determination under s 8) may qualify for s 296 leave, subject to leave criteria and absence of alternative remedies.

Detention on 29 May 2009 was lawful despite the absence of a completed s44 warrant because s136(1) of the Summary Proceedings Act authorised arrest without warrant following the High Court determination, the s44 warrant requirement is procedural/administrative, and subsequent District Court warrants further regularised the detention; therefore habeas corpus relief is not available.

The application is dismissed because s14(2)(b) of the Habeas Corpus Act 2001 prevents the High Court from questioning a bail ruling of a court of competent jurisdiction, and the District Court had jurisdiction under the Summary Proceedings Act 1957 (ss46,47) to remand the applicant including for more than eight days without consent, so the High Court has no jurisdiction to grant habeas corpus relief in respect of that remand.
