Absent any qualifying ground under r14.7 to refuse or reduce costs, costs must follow the event; Minotaur was required to repay the costs previously paid after the High Court judgment and to pay the Council's costs as quantified, subject to limited adjustments for specific claimed items that were inappropriate or excessive.

The recall application was granted because the Court had proceeded on the mistaken impression that no High Court costs order had been made; correction required quashing the High Court costs order (which had resulted from the parties' agreement) and ordering the respondent to repay the $5,920 she had received; the respondent must also pay appellants' costs and disbursements for the recall application.

A formal order for repayment of the tribunal-awarded costs was required to give the Court jurisdiction to consider and award interest under r 20.20(2)(b); accordingly the Court ordered repayment of $36,312.38, fixed appeal costs at $5,672 payable by the respondents, and directed the respondents to account to the appellants for the actual interest earned on the funds while held on deposit rather than awarding the claimed statutory rate interest unqualified.
