Because the applicant raised a seriously arguable challenge to the lawfulness of the Miro Unit rules and the balance of convenience favoured preserving the applicant's position, the Court granted an interim declaration restraining the Crown from implementing the disciplinary sentences pending the outcome of the High Court proceedings.

The Court held Rule 1104(3)(c) validly permitted the Operations Manager of the RIU to approve non-race day informations; approval of the Hong Kong laboratory was not unlawful and issues about reserve sample testing are matters of admissibility and weight for the JCA; no legitimate expectation to be consulted about new testing methods was established; and the decision to lay the charge was reasonable and lawful under the mandatory disqualification regime.
