The High Court found the factual findings that Jazz initiated the incident, put her head through the fence, seized and severely injured Nimbus, and that the conduct constituted a normal territorial attack; those immediate circumstances were not exceptional under s 57(3), so the District Court's destruction order was correctly made and is upheld.
