The Supreme Court lacks jurisdiction to grant leave because the Criminal Procedure Act 2011 makes High Court determinations of second appeals final (s 242), so the application for leave to appeal is dismissed.

Leave to appeal was dismissed because no exceptional circumstances were shown to justify a direct Supreme Court appeal, the proposed appeal was fact specific and raised no question of general or public importance or appearance of miscarriage of justice, and the High Court had already considered the evidence and refused leave.

The Court declined to exercise its inherent jurisdiction to reopen the appellants' concluded appeals because the applicants failed to show a fundamental error of appellate process that impeached the earlier decision, alternative remedies (eg s 406 Crimes Act) remained available, and the acquittal of Morton did not on its own establish an unavoidable inconsistency or miscarriage of justice given materially different evidence at the retrial (notably the accuseds' testimony).
