The handwritten solicitor's file note was declared the deceased's valid will under s14 because it appeared to be a will and the solicitor's affidavit provided clear, reliable evidence that the file note expressed the deceased's testamentary intentions; however the court will limit validation to the actual written terms and will not insert undocumented testamentary provisions (eg. debt forgiveness or additional occupancy conditions).
