The Court found the sentencing Judge erred by not taking adequate account of the appellant's traumatic upbringing which the Crown accepted was causally linked to the family violence offending; applying a 15% discount to reflect reduced culpability led to substitution of the 15‑month sentence with a 13‑month sentence for the relevant charges.

The District Court erred only in selecting an excessive starting point for the attempt to pervert the course of justice; no impermissible double counting of prior convictions occurred; the 15% uplift for prior convictions and offending on bail was appropriate; home detention was not available because the offender was ineligible for a short‑term sentence under s15A, and the appropriate substituted sentence is two years and ten months' imprisonment.

The High Court refused to interfere. The sentencing Judge's discretionary choices were within range: a five-year global starting point and a 20% discount for upbringing, addiction and rehabilitation were justified given limited nexus and reliance on self-reporting; the 20% guilty-plea discount was generous but not plainly wrong despite lateness; a nine-month deduction for extensive electronically monitored bail including long curfew was within sensible discretionary bounds. On appeal the Court found the starting point adopted by the sentencing Judge was excessive for the appellant's role; set a reduced starting point of six years, allowed appropriate uplifts for additional offending and for conduct on bail, applied defined discounts (modest remorse 5%, guilty plea 15%, youth 20% as relevant in calculation) and substituted an aggregate sentence of four years and eleven months imprisonment; the Court quashed the imposed 50% MPI as unnecessary and noted the objectionable material in a VIS was not relied on for sentencing.
