The application to suspend sentence was declined because the sentence in respect of which suspension was sought had already been served, there was therefore no sentence to suspend, and delay in progressing the matter was attributable to the applicant; consequently no basis existed to grant suspension and only the conviction remains to be determined.

The application for suspension of sentence was granted because, on preliminary assessment, although the leave application did not appear particularly meritorious, the welfare of animals and the SPCA's resource concerns, combined with the SPCA's lack of opposition and the need for an early hearing, justified suspending the sentence pending determination of the leave application; the statutory power to suspend is founded on s 333(4) Criminal Procedure Act 2011.

The Supreme Court does not have jurisdiction to suspend the operation of a disqualification order pending determination of a leave application because no statute authorises such a suspension in these circumstances and s 144B of the Summary Proceedings Act 1957 does not operate to create that power; accordingly the application for deferral must be dismissed.
