Although Mr Pandey actively ran the defendant's defence and exhibited personal animosity, the Court found he was not a financial funder nor stood to materially benefit and did not bear the litigation risk; therefore the exceptional jurisdiction to order costs against a non-party was not satisfied and the application was dismissed.
