The Court awarded costs to Ms Ma totalling $16,318.00, refused orders for indemnity or increased costs, fixed time band A for Mr Tay's security for costs application (limited time incurred) and time band B for Ms Ma's strike out application with an allowance for affidavit preparation by analogy to Schedule 3 allocations.

The first defendant failed to establish that the steps it took warranted uplift to category 2C across the board and did not follow the Holdfast framework; therefore only preparation of witness statements was re-banded to 2C, all other approved steps remain at category 2B, and the first defendant must produce invoices to support claimed disbursements before recovery will be allowed.

Indemnity costs were refused because Manson did not act vexatiously, frivolously or wilfully disobey court directions and there was an arguable legal and factual basis for joinder at the time it was filed; however the Court reclassified Manson's claim as category 3, awarded C banding for specified steps, allowed expert costs as reasonably incurred, uplifted time for the strike-out application by 50% for unnecessary contribution by Manson, and awarded Franklin its costs of the application on a 2B basis with disbursements fixed by the Registrar.
