The Court of Appeal held that the official birth certificate issued by the competent civil registrar was the decisive proof of the victim’s age and reduced the sentence to 10 years.
The Court found that the victim was a minor at the time of the offence based on a valid birth certificate, and that Niyonkuru Eric was an adult. Despite the gravity of the offence, the Court recognized mitigating circumstances including the accused's admission of guilt, first-time offence, and lack of prior criminal record, warranting a reduction of the sentence from ten to six years' imprisonment.
The Court of Appeal upheld a defilement conviction for one victim, acquitted the defendant on another count for lack of proof of age, and reduced the sentence to 20 years.
The Supreme Court of Rwanda upheld a child defilement conviction, finding documentary evidence proved the complainant was under 18 and that consent was legally irrelevant.
