Article 16(3) of the UNCITRAL Model Law, as incorporated into Hong Kong law by s.13B of the Arbitration Ordinance, permits arbitrators to rule preliminarily on jurisdiction and removes any right of appeal against such preliminary rulings; consequently no leave to appeal was available, the plaintiff's declaration summons was procedurally wrong and dismissed, and the defendant's strike out summons was granted with limited costs.
