The court declined to force the defendant to sign the Deed of Rectification but held that under s38A DCO it could nominate a person to execute the deed. Due to potential conflict of interest it was improper to appoint the plaintiffs' solicitors who caused the defect; consequently the Registrar of the District Court was the appropriate nominee to execute the Deed of Rectification on behalf of the defendant. Plaintiffs must submit the deed within 90 days for the Registrar's approval and execution; no order as to costs, on the firm's undertaking not to charge the plaintiffs.
