Applying s23 of the Pawnbrokers Ordinance and the principles in Legrand, the owner took reasonable precautions and was not at fault; the pawnbroker failed to take serious and effective steps (failed to make basic enquiries, relied on inadequate record-keeping and did not detect suspicious repeated pawning) and thus caused or contributed to the unlawful pawning; there is no reasonable prospect of success on appeal and leave is refused.
