The magistrate acted properly by disclosing his prior professional dealings, hearing the parties, and recusing himself once the defence became a personal and offensive attack on the witness; the decision to order a trial de novo was reasonable and lawful, so the applicant's judicial review is dismissed.

The court quashed the Commissioner's decision because the Presiding Officer sent undisclosed, prejudicial comments to the Commissioner urging the appeal be dismissed, thereby breaching fairness and impartiality; the Presiding Officer's failure to consider the defence of reasonable self‑defence also caused substantial prejudice. Those defects warranted certiorari and quashing of both the disciplinary finding and the Commissioner's dismissal of the appeal.

The Appeals Committee's decision is not subject to judicial review because, although Lingnan University is a statutory public body, the Appeals Committee was an internal/consensual disciplinary body of a domestic character and not a statutory tribunal; alternatively, even if reviewable, there was no breach of natural justice (procedures were appropriate to an informal inquisitorial disciplinary forum), adequate reasons were given, the finding of misconduct was supported by evidence, the reprimand was not entered into the academic transcript, and in any event the court would exercise its discr…
