The court construed the covenant 'not to erect more than one house' as a numerical restriction on the number of buildings permitted on a lot and read 'house' in the context of the Conditions of Exchange as encompassing a building that could include multi‑storey composite structures; consequently a composite multi‑storey building straddling the five lots did not, by virtue of straddling or size alone, breach the covenant.
