Section 65D of the Criminal Procedure Ordinance (Cap.221) does not apply to trials in the District Court; alternatively, even if it applied the court would exercise its discretion to grant leave for the defence to call alibi evidence, based on legislative context, omissions in related statutes, procedural differences and the rule of criminal interpretation favouring the accused.
