Section 65D of the Criminal Procedure Ordinance does not apply to trials in the District Court; the trial judge erred in applying it to refuse leave to adduce alibi and to prevent calling supporting witnesses, and because the appellant was thereby deprived of the opportunity to present alibi evidence the robbery conviction was quashed and a new trial ordered.
