The Companies were ordered to pay HSBC's costs on an indemnity basis because the court was satisfied, having regard to findings in the SDNY judgment and the undertakings recorded in the Hong Kong order, that the Companies' management had given undertakings they did not intend to comply with, conduct amounting to an affront to the court; additionally the Companies discontinued the summons for their own reasons without any concession by HSBC. The court also restrained release of the documents without a Hong Kong court order.
