Although the trial judge was entitled to apply Cap.618A reg 5, he introduced that statutory basis only after close of cases and contrary to the prosecution's pleaded reliance on the industry Code, thereby causing procedural unfairness and depriving the appellant of a real opportunity to meet the altered case; that unfairness required quashing the conviction despite findings that the appellant had knowingly made false entries.
