Conviction was quashed because the Magistrate relied primarily on CCTV without reconciling it with uncontradicted eyewitness evidence that the appellant was attacked, leaving a lurking doubt and meaning the prosecution failed to prove beyond reasonable doubt that the appellant was fighting.

The magistrate erred by treating the appellant's splashing of tepid water as an assault and by failing to consider whether the appellant's subsequent actions amounted to reasonable self-defence; on re-hearing the court found the prosecution failed to displace the possibility of self-defence and the conviction was therefore unsafe and was quashed.

The learned Magistrate's assessment that PW1 was credible and that the prosecution proved beyond reasonable doubt that the appellant struck PW1 and that both parties took part in a fight was unimpeachable on appeal; self-defence did not arise on the evidence; given the facts and appellant's prior violent convictions the sentence of 18 weeks imprisonment was not manifestly excessive and was properly imposed.

Appeal allowed because the magistrate accepted the co-defendant's account that he did not fight while convicting the appellant for fighting; that factual inconsistency meant the charge of fighting was not properly established and the magistrate should have considered amending the charge under s27 to reflect a one-sided assault, so the conviction could not stand and was quashed.
