The magistrate, despite duties to assist an unrepresented defendant and to address material inconsistencies, failed to put significant discrepancies in the prosecution witnesses' evidence to them and conducted questioning in a manner that gave the appearance of partiality; that departure from accepted norms so seriously disadvantaged the appellant that his trial was unfair, rendering the conviction unsafe and requiring quashing and an award of disbursements.

The appeal was allowed because the magistrate must have relied on judicial notice of a particular deception modus operandi not placed before the court, that modus operandi was not shown to be of the kind the ordinary person would be presumed to know, and the magistrate failed to notify the defence that she might take judicial notice, depriving the defence of the opportunity to respond and rendering the conviction unsafe.

Exposure of a magistrate to an accused's previous record during bail proceedings does not automatically vitiate a subsequent trial; the trial may proceed so long as the magistrate can and does act without bias, and the same standard applies to magistrates as to District Judges and higher courts; in this case the magistrate demonstrated no improper influence and the convictions were warranted by the evidence.
