On the evidence the plaintiff suffered non-serious but material injuries with scarring, intermittent pain and psychological sequelae; in absence of medical expert opinion the court relied on contemporaneous hospital records, witness testimony and comparable authorities to fix PSLA at HK$180,000; court accepted proved special damages (medical HK$2,050 and travel HK$803.90), deducted HK$2,500 received, and ordered interest and costs as specified.

Court found the accident caused the scald injuries and psychiatric condition but materially interacted with long-standing poorly controlled diabetes; apportioned 20% to the pre-existing diabetic condition, accepted expert causation but rejected the claimant’s asserted pre-accident earnings and any award for loss of earning capacity for want of credible contemporaneous evidence, and awarded PSLA HK$160,000, special damages HK$15,000 and future medical HK$15,000 (total HK$190,000) plus interest and costs on the terms ordered.

The court accepted the Plaintiff's unchallenged evidence and the expert medical report, concluded the injuries were a relatively mild example of their type with 2% whole person impairment, and awarded PSLA of HK$200,000 and special damages of HK$17,000 (total HK$217,000). Interest and costs were ordered as specified because service was proved and the defendant did not attend, and partially undocumented expenses were allowed in reasonable sums based on authority and the injuries sustained.

2nd defendant held vicariously liable for negligent driving of 1st defendant; contributory negligence of 1st plaintiff not established because no evidence linked failure to wear seat belt to the injuries; alleged pre-existing conditions insufficiently proven to reduce PSLA; evidence supported soft tissue injuries with limited residual disability so PSLA fixed at HKD100,000 each; loss of earning capacity not established for either plaintiff; agreed special and post-trial expenses awarded and interest and costs ordered as specified.

The defendant failed to demonstrate a reasonable prospect of success on appeal because she did not identify any legal error or serious factual misassessment in the PSLA award; the award of $450,000 was supported by comparable authorities and was not so high as to be an entirely erroneous estimate; accordingly leave to appeal and stay pending appeal were refused.

Appeal allowed in part: the Court found the trial judge undervalued the psychiatric component of harm and wrongly disregarded tips without making any assessment; the Court substituted an award of HK$400,000 for PSLA and recalculated pre-trial loss of earnings at HK$276,000 by accepting a monthly income of HK$10,000 (base HK$7,082.83 plus assessed tips HK$2,000-3,000) and applying 15 months total loss plus 21 months partial loss at reduced sums.

Plaintiff's injuries amount to a Serious Injury; PSLA awarded at HK$580,000. Pre-trial loss of earnings denied because plaintiff was not lawfully employable while on recognizance and therefore lacked the prerequisite for compensation under s10 ECA and the same principle applies at common law. Credit of HK$120,960 for Employees' Compensation payable is deducted, leaving total damages HK$459,040 plus interest and costs as ordered.

The court preferred the Defendant's evidence that a physical assault occurred and that illegitimate pressure continued thereafter; the 2006 Deed was therefore procured by duress and is voidable and has been avoided by the Defendant; there was no credible evidence to establish an express or resulting trust in 2001 (Plaintiff's will amendment contemporaneous with the 2001 Deed indicated intent to divest); accordingly Plaintiff's partition and declaration claims fail, the 2006 Deed is set aside, and Defendant entitled to damages (HKD100,000 general; HKD40,000 aggravated), interest and costs.
