Applying Mega Bloks and related authorities the court found the essential features of the applied-for shapes are necessary to obtain technical results (flat rectangular consoles and memory card; controllers with two legs and a rung), thus excluded by TMO s.12(3)(b); independently, the shapes are common and neither inherently nor factually distinctive under TMO ss.9 and 10; accordingly appeals dismissed and costs ordered.
