The Court of Appeal held that a period of remand in custody pending a criminal trial that results in conviction is not excluded by s2(4)(b) of the Immigration Ordinance from being a period of ordinary residence; the court found the issue to be of significant general public importance and granted leave to appeal to the Court of Final Appeal on the construction of s2(4)(b) and the question whether remand periods count as ordinary residence.
