The Court of Appeal held that the judge's dismissal of the action against the 1st defendant should be set aside because the plaintiff had an arguable Replacement Statement of Claim and therefore should be granted leave to file it; the judge's striking out of the SOC as against the 2nd defendant and robust criticisms were largely justified; the costs order below was affirmed and the 1st defendant was entitled to the costs of the appeal on a party and party basis but not indemnity costs.
