Section 4(1) of the Detention Centres Ordinance prevents a court from imposing any other sentence in respect of an offender on whom a detention order is made; accordingly the six-month imprisonment sentences under the Theft Ordinance were unauthorized and were quashed and replaced with detention orders.

The learned Magistrate failed to comply with s.109A by not obtaining and considering probation and training centre remand reports for 20‑year‑old appellants; after reviewing such reports the appellate court concluded probation was unsuitable and that detention in a training centre was the appropriate disposal, and therefore substituted training centre detention for the original imprisonment sentences.
