The applications for leave to appeal are refused because the Presiding Officer correctly found that clause 8.7.2 did not form part of most claimants' contracts or was not breached on the facts, accepted the claimants' evidence, and the defendant failed to demonstrate any arguable point of law as required by Labour Tribunal Ordinance s32(1).

The Court of First Instance lacks power to extend the 14-day time limit for applying for leave to appeal under Order 59 rule 2B(1) once that period has expired; accordingly leave to apply for leave to appeal out of time was refused and the out-of-time leave application dismissed. The statutory threshold for granting leave is that the appeal has a reasonable prospect of success (more than arguable but not necessarily probable).
