The Court affirmed the trial judge's findings that the 3rd and 4th defendants knowingly misrepresented the nature and effect of the documents to the plaintiff, that the 2nd defendant held the property on constructive trust for the plaintiff because it was not intended to receive a gift or consideration and acted as nominee, and that the judge was entitled to reject Mr Yau's evidence in light of documentary inconsistencies and inadequate explanations; the appeals were therefore dismissed.
