The Court upheld the trial judge's finding that, on the totality of the evidence (timing of deposits and ATM withdrawals, the nature of the notes, and the Applicant's interview admissions), it was open and proper to infer that the Applicant deposited the counterfeit notes and that he knew or suspected they were counterfeit; the appeal was dismissed.

The applicant was properly convicted on overwhelming admissible evidence; his asserted motive to act as an informer did not negate guilt and did not warrant credit; the trial judge rightly disregarded the claim of assisting in exposing co-conspirators; the sentence of 39 months' imprisonment was within the judge's discretion and not so excessive as to justify interference.

Where a defendant, including an unrepresented defendant, offers a plea to a lesser offence which the prosecution does not accept, that offer does not constitute an admission under section 65C; the defendant remains entitled to deny the alleged facts and to cross-examine on possession. The magistrate erred in treating the unaccepted plea as an admission and in disallowing cross-examination; conviction must be quashed and retrial ordered.

Because the appellant's statement and the Brief Facts were admitted under section 65C, the magistrate was bound by those admissions and could not properly draw adverse inferences beyond them; the magistrate had therefore been 'shackled' by the admissions, mens rea as denied in the appellant's statement had to be accepted, and the conviction could not stand.
