The trial evidence — an eyewitness account accepted by the trial judge and clear dashcam footage showing the taxi cutting from the second into the first lane at a very close distance causing the other driver to brake — established the elements of careless driving beyond reasonable doubt; on rehearing the High Court accepted that evidence and upheld the conviction.

On a re-hearing the court was satisfied beyond reasonable doubt that the appellant had control and possession of the two speakers (established by label, telephone admission and on-scene acknowledgement) and that those speakers emitted broadcasts which caused annoyance to the prosecution witness; ownership plus admission and presence established sufficient control to convict and good motive was no defence.

Appellant failed to prove, on the civil standard required by s16A(1), that it did not receive the notice and that any non-receipt was not due to its negligence: company had moved address with sufficient time to update records, had prior incidents of lost mail and took no reasonable steps to prevent or investigate missing mail; magistrate's factual findings were justified and appellate court, on re-hearing, found no error, therefore appeal dismissed.

Although the trial judge misstated the s.26AAB evidential standard, the court on re-hearing found the totality of evidence — expert reports showing visibly poor workmanship on many shoes, appellant's control of premises and keys, signing of delivery documents, receipt of payments, and involvement in packing/dispatch — established beyond reasonable doubt that the appellant knew of or had reasonable grounds to suspect the goods bore counterfeit trademarks and was in possession of the exhibits; appeal dismissed and convictions upheld.
