The trial judge's acceptance of the prosecution witness as credible, supported by contemporaneous video, meant the prosecution proved beyond reasonable doubt that the appellant intentionally struck a police officer who was executing his duty; the conviction was therefore safe. The sentence of three months' imprisonment was within principled sentencing bounds given the need for deterrence and the appellant's prior violent conviction; a community service order was inappropriate.

The application to consolidate was dismissed because, given the proximity of the existing trial dates and the lack of a sufficient material change in circumstances, the prosecution failed to justify vacating milestone trial dates under Practice Direction 9.3; the cited precedents and projected facility improvements did not avail for the proposed period, and consolidation would cause disproportionate prejudice to defendants through disruption of counsel diaries and increased public health risk.

On rehearing the court found the prosecution excluded the possibility of accident beyond reasonable doubt: the officer clearly identified himself twice, the CCTV and witness testimony consistently show the appellant deliberately extended his right foot to trip the officer, and the judge properly assessed credibility and context; accordingly the conviction for assaulting a police officer under Cap.232 s63 is safe and the appeal is dismissed.

The High Court dismissed the appeal against conviction because (1) the fresh video and screenshots did not materially contradict PW1's identification evidence; (2) PW1 was found credible on identification and the trial judge reasonably inferred the appellant had held a green laser which was lost during chaotic restraint; but allowed the sentencing appeal and reduced the custodial sentence because the original 3‑month starting point was unduly severe in the statutory maximum context and a 7‑week immediate term better reflected proportionality and mitigating factors.

The magistrate's imposition of a 12‑month probation order was wrong in principle and manifestly inadequate for an assault on a police officer involving a potentially lethal weapon in the context of public disorder; the Court set aside the probation order and substituted a Rehabilitation Centre Order because immediate custodial treatment with counselling better balanced public deterrence and the respondent's rehabilitative needs given he was unsuitable for Detention Centre.
