Court found husband to be an unreliable and partially dishonest witness and accepted the wife’s account that loans were procured and used for the car; disallowed the claimant’s claim for an asserted large interest component but held husband liable for outstanding principal, fees and late charges totalling HK$35,877; ordered repayment by instalments because that meets parties’ needs and is practical under s.7 analysis.

On the balance of probabilities the court found the bankrupt had materially concealed assets and failed to cooperate with trustees in the administration of the estate, establishing the trustees' grounds under section 30A; therefore the automatic discharge was suspended for four years to permit investigation and realisation of assets and to protect public interest; costs were awarded to the trustees.

The judge rejected the husband's theft allegation for lack of credible direct evidence, inferred the husband remained in possession of the RMB 110,000 (HK$129,800) but did not accept that the wife owed $530,000 or that the husband had hidden assets; after ascertaining total matrimonial assets of HK$920,487 and assessing needs, the court applied an equal division yielding a capital payment by the wife of HK$260,000 to the husband and ordered child maintenance of HK$4,200 per month and a clean break.
