    The court awarded interim maintenance of HK$6,650 per month payable by the father based on (a) treating half of general household expenses as attributable to the mother and splitting child-related costs equally; (b) excluding the mortgage as a capital expense but including the domestic helper cost as a child expense; (c) reducing unproven extracurricular and entertainment costs; and (d) not permitting the father to deduct expenses he incurs while the child is with him. The award is not backdated and costs are ordered nisi to follow the event.

    On the broad‑brush approach under s 5 MPPO the court apportioned child‑related and attributable household expenses equitably: exclude mortgage as capital expense, include domestic helper as child care expense, exclude entertainment/holidays and certain unproven items, accept an equal split of child costs despite slight income difference. Applying that method the father was ordered to pay HK$6,650 per month as interim maintenance, payable from 1 June 2016 monthly, not backdated; costs ordered nisi to the mother to be made absolute in 14 days; first appointment adjourned to 29 July 2016.

    The judge determined net monthly incomes (W HK$65,000; H HK$55,560), found the children's expenses and the accommodation reasonable in the Hong Kong context, concluded it was fair to backdate maintenance to the children's arrival because the petitioner had been sole supporter and faced imminent loss of income, and therefore ordered specified interim payments and repayment instalments with accounting for sums already paid by the respondent.
