The Inquiry Committee was entitled under regulation 8(4) to admit and take into account E22 and E23 notwithstanding that E22 had been ruled inadmissible in the criminal trial; exclusion in criminal proceedings does not automatically preclude use in disciplinary inquiries, and the committee applied appropriate caution and procedural safeguards so the admission did not render the inquiry unfair. The appeal is therefore dismissed.
