The husband's mortgaging of the matrimonial home and drawing on the facility constituted a dealing in the property which had the effect of reducing assets available for financial provision; under s.17(3) the presumption that the dealing was intended to defeat the wife's claim arose and was not rebutted on the evidence, entitling the wife to the restraint order sought.
